Privacy Notice

OL Defensa recognizes that the information it receives from clients and from those requesting a consultation is, by its nature, sensitive and confidential. This notice explains what data we collect, what we use it for, who we may share it with, and how you can control it at any time.

02Personal data we collect

We collect data in three ways: what you provide directly through this site's form, by telephone, WhatsApp or email; what we obtain in the initial interview and during the course of the matter; and what is generated in the case files and proceedings.

Identification and contact data

• Full name, telephone, email address and address
• Signature, official identification and, where applicable, tax and population registry numbers
• Details of representatives, attorneys-in-fact or family members involved in the matter

Financial and asset data

• Accounting, tax and financial information necessary for the defense
• Assets, accounts and transactions connected to the matter
• Billing and fee payment details

03Sensitive personal data

Given the nature of criminal law, our services may require processing data the law deems sensitive, including physical or mental health data, information about criminal, administrative or tax proceedings to which you are a party, biometric data, and where relevant to the defense or to the representation of a victim, information about sexual life or ethnic origin.

This data is handled under strict confidentiality and is further protected by attorney-client privilege. It is collected only where indispensable to the matter, and its processing requires your express consent, obtained in writing when the professional relationship is formalized.

04Purposes of processing

Primary purposes (necessary)

Without these uses we cannot provide the service:

• Responding to your enquiry and making a preliminary assessment of your situation
• Identifying you and verifying your identity
• Providing the contracted defense, representation, advisory, consulting, audit and compliance services
• Preparing filings, briefs, opinions and other documents in the matter
• Appearing and acting before prosecutorial, judicial and administrative authorities
• Invoicing and collecting fees, and meeting tax and accounting obligations
• Complying with obligations imposed by applicable law and by the competent authorities

Secondary purposes (optional)

These uses are not necessary for the service and you may refuse them without affecting the handling of your matter:

• Sending you the firm's newsletters, legislative alerts and legal analysis
• Inviting you to conferences, courses and academic events
• Assessing service quality through surveys

If you do not wish your data to be used for these purposes, write to contacto@oldefensa.com.mx with the subject line "Limitation of use". We have five business days to process your request.

05Data transfers

Your personal data is never sold, assigned or traded. It may only be transferred in the following cases:

• To authorities, whether prosecutorial, judicial, tax or administrative, where necessary for the defense of your matter or where required by law
• To expert witnesses, forensic accountants and investigators collaborating with the firm on your matter, bound by confidentiality obligations
• To corresponding lawyers of the Alianza Penal network, where your matter requires action in another state
• To third parties where there is a duly founded request from a competent authority, or in the cases set out in article 37 of the law

These transfers are necessary to provide the service and, under article 37 of the law, do not require your additional consent. In every case we require the recipient to apply the same level of protection and confidentiality.

06Your ARCO rights

You have the right to know what data we hold and what we use it for (Access), to ask us to correct data that is inaccurate or incomplete (Rectification), to request deletion where you believe it is not being used lawfully (Cancellation), and to object to specific uses (Objection). You may also withdraw any consent you have given us.

To exercise any of these rights, send your request to contacto@oldefensa.com.mx with the subject line "ARCO rights", including:

• Your name and a means of sending you our reply
• A copy of your official identification, or of the power of attorney if a representative is acting
• A clear description of the data to which the right relates
• Any document that helps us locate your data
• For rectification, the correction requested and supporting documentation

We will reply within a maximum of twenty business days and, where the request is granted, will act on it within the following fifteen business days. Exercising these rights is free of charge, other than reproduction or delivery costs.

Legal limitation: cancellation or objection may not apply to information forming part of a live case file, or that we must retain by law, for tax obligations, or to meet obligations arising from the professional relationship.

07Data retention

We retain your data for the duration of the professional relationship and, once it ends, for the period required by applicable law and for as long as needed to address liabilities arising from the matter. After those periods, the data is blocked and then securely deleted.

08Security measures

We maintain administrative, technical and physical measures to protect your data against damage, loss, alteration, destruction, and unauthorized use, access or processing. All personnel and collaborators of the firm are bound by confidentiality obligations that survive the end of their relationship with OL Defensa.

09Cookies and tracking technologies

This site does not install advertising or profiling cookies. It may use technical storage strictly necessary for the page to work. If analytics tools are added in future, this notice will be updated and your consent obtained where the law requires it.

The site loads typefaces from Google Fonts servers, which means your IP address may be known to that provider under its own policies.

10Changes to this notice

This notice may change due to legal reforms, changes in our services or in our own privacy practices. Any change will be published at this same address, showing the date of last update. We suggest you check it periodically.

11Data protection authority

If you believe your right to the protection of personal data has been infringed, you may approach the competent authority. Before doing so, we ask that you allow us to address your complaint by writing to contacto@oldefensa.com.mx.
